ComXo Ltd Website Policy

These Website Terms of Use apply when you (“You”/”Your”) access ComXo.co.uk and ComXo.com (the “Sites”). By accessing the Sites, You agree to be bound by the Website Terms of Use. If You do not agree to be bound by these Website Terms of Use, You may not access or use the Sites and must leave immediately. The Sites are offered to You (“Your”/”You”) by ComXo Ltd (“We”/ “Us”/”Our”).

You acknowledge that We will not be party to any transaction or contract with a third party that You may enter into and We shall not be liable to You in respect of any loss or damage which You may suffer by using those websites. You agree that You will not involve Us in any dispute between You and the third party.

  5. Your legal options and Your promises

  6. Our legal obligations and limits on liability
    1. Nothing in these Terms of Use shall exclude or limit Our liability for fraudulent misrepresentation or for death or personal injury resulting from Our negligence or the negligence by Us, Our employees or agents.
    2. We do not accept any liability for damage to Your computer system or loss of data that results from Your use of the Sites and We cannot guarantee that any files that You download are free from viruses, contamination or destructive features.
    3. Whilst We use all reasonable endeavours to correct any errors or omissions as soon as practicable once they have been brought to Our attention, We do not promise that the information on the Sites will be free from errors or omissions and do not promise that the Sites will be available uninterrupted and in a fully operating condition. Access to the Sites may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond Our control.

Our liability in tort, contract, negligence, pre-contract or other representations or otherwise arising out of or in connection with and/or these Website Terms of Use shall be limited in aggregate over any 12 month period to the net payments to Us from You in any one-month period using Our services or £1,000, whichever is the lesser as relevant.
    5. We will co-operate with any law enforcement authorities or court order requesting or directing Us to disclose the identity of or locate anyone breaching these Website Terms of Use or otherwise for the prevention or detection of crime or the apprehension or prosecution of offenders.

  8. Changes to these website terms of use
    1. We reserve the right to amend these Website Terms of Use at any time. All such changes will take effect once they have been posted on the Sites and You will be deemed to have accepted any such changes by Your use of the Sites from such time.
  9. Severance

If any provision of these Website Terms of Use shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Website Terms of Use which shall remain in full force and effect.
  10. Law and jurisdiction
    1. These terms shall be governed by and interpreted in accordance with the laws of England. Disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  11. Force majeure
    1. In these Terms of Use, a “force majeure” event shall include, without limitation, strikes, lock-outs or other industrial disputes, nuclear accident or acts of God, war or terrorist activity, riot, civil commotion, malicious damage, compliance with any law or government order, rule regulation or direction, accident breakdown of plant or machinery, fire, flood, storm or default of suppliers, and where they are beyond Our reasonable control, any other acts, events, omissions or accidents.
    2. We shall not be liable for any failure, any suspension or any termination of access to the Sites or any content in connection with or arising out of a force majeure event.
